SENATE BILL 247
AN ACT RELATING TO FILLING VACANCIES ON BOARDS OF COUNTY COMMISSIONERS.
The General Assembly of North Carolina do enact:
Section 1. Section 153-6 of the General Statutes of North Carolina is rewritten to read as follows:
"Sec. 15.3-6. Vacancies. Vacancies occurring in the board of commissioners of any county shall be filled by appointment by the remaining members of the board. The person appointed to fill a vacancy shall be a member of the same political party, and, if the county is divided into districts for election of the board, a resident of the same district, as the member causing the vacancy. The board shall consult the county executive committee of the appropriate political party before filling a vacancy, but shall not be bound by its recommendations."
Sec. 2. All laws and clauses of laws in conflict with this Act are repealed to the extent of such conflict.
Sec. 3. This Act shall take effect upon its ratification.
