HOUSE BILL 1134

AN ACT TO ALLOW A TRIAL JUDGE TO COMPEL THE DISCLOSURE OF INFORMATION WITHIN THE PHYSICIAN-PATIENT PRIVILEGE IF JUSTICE REQUIRES.

The General Assembly of North Carolina do enact:

Section 1.  G.S. 8-53 is hereby amended by deleting "presiding judge of a superior court" in line 6 and inserting "Court, either at the trial or prior thereto,".

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective July 1, 1969.

In the General Assembly read three times and ratified, this the 19th day of June, 1969.
