SENATE BILL 301

AN ACT to exempt the department of Transportation from the required approval of the council of state when purchasing contaminated property, as recommended by the Department of Transportation.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 133‑40(a) reads as rewritten:

"(a)       For purposes of this Article, the term "public entity" means the State and the Community College System.System; provided, however, that the term does not include the Department of Transportation in the exercise of the powers conferred by G.S. 136‑19."

SECTION 2.  This act is effective when it becomes law.
