AN ACT relating to the release of animal services records IN GUILFORD COUNTY AND AUTHORIZING THE CITY OF GREENSBORO TO DISCLOSE LIMITED PERSONNEL INFORMATION CONCERNING THE DISPOSITION OF DISCIPLINARY CHARGES AGAINST A POLICE OFFICER TO THE CRIMINAL JUSTICE ADVISORY COMMISSION AND ITS SUBCOMMITTEE, THE POLICE COMMUNITY REVIEW BOARD, DESIGNATED BY THE CITY COUNCIL TO PROVIDE CITIZEN REVIEW OF THE POLICE DISCIPLINARY PROCESS.
The General Assembly of North Carolina enacts:
PART I. RELEASE OF ANIMAL SERVICE RECORDS IN GUILFORD COUNTY
SECTION 1.(a) Chapter 132 of the General Statutes is amended by adding a new section to read:
"§ 132‑1.15. Personally identifiable records relating to county animal services.
(a) Personally identifiable information held by a county animal services agency that relates to any of the following persons is not a public record as defined in G.S. 132‑1:
(1) An individual who has voluntarily surrendered ownership of an animal to an animal shelter.
(2) An individual who has adopted a shelter animal or to whom a shelter animal has been placed through a foster program.
(b) When a county animal control service places animals with an animal rescue organization, the identity of the animal rescue organization is a public record as defined in G.S. 132‑1.
(c) Disclosure or nondisclosure of information that is not a public record under this section may be made in the county's discretion."
SECTION 1.(b) This section applies to Guilford County only.
PART II. AUTHORIZE THE CITY OF GREENSBORO TO DISCLOSE CERTAIN INFORMATION
SECTION 2.(a) G.S. 160A‑168(c)(8), as amended by S.L. 2001‑20, reads as rewritten:
"(8) In order to
facilitate citizen review of the police disciplinary process, the city manager
or the chief of police, or their designeesdesignees, may release
the disposition of disciplinary charges against a police officer and the facts
relied upon in determining that disposition to the Human Relations
Commission Complaint Subcommittee, and Criminal Justice Advisory
Commission and its subcommittee, the Police Community Review Board, designated
by the city council to provide citizen review of the police disciplinary
process. The city manager, chief of police, or their designees, and the
Criminal Justice Advisory Commission and its subcommittee, the Police Community
Review Board, may release the disposition of the disciplinary charges to
the person alleged to have been aggrieved by the officer's actions or to that
person's survivor. Commission members The members of the Criminal
Justice Advisory Commission and its subcommittee, the Police Community Review
Board, shall maintain as confidential all personnel information released to
them under this subdivision that is not a matter of public record under this
section, and any member who violates that confidentiality is guilty of the
violations set forth in subsections (e) and (f) of this section. Each member of
the CommissionCriminal Justice Advisory Commission and its
subcommittee, the Police Community Review Board, shall execute and adhere
to a confidentiality agreement that is satisfactory to the city. For purposes
of this subdivision, the term "disposition of disciplinary charges"
includes determinations that the charges are sustained, not sustained,
unfounded, exonerated, classified as an information file, or classified as any
other disciplinary disposition category subsequently adopted by the Greensboro
Police Department."
SECTION 2.(b) This section applies to the City of Greensboro only.
PART III. EFFECTIVE DATE
SECTION 3. This act is effective when it becomes law.
