AN ACT RENAMING THE BEAUFORT‑MOREHEAD CITY AIRPORT AUTHORITY AS THE CARTERET COUNTY‑BEAUFORT AIRPORT AUTHORITY, INCREASING THE MEMBERSHIP OF THE AIRPORT AUTHORITY FROM FIVE TO SEVEN MEMBERS, AND CHANGING THE MANNER OF APPOINTMENT TO THE AIRPORT AUTHORITY.

The General Assembly of North Carolina enacts:

SECTION 1.  Section 1 of Chapter 426 of the Public‑Local Laws of 1941, as amended, reads as rewritten:

"Sec. 1. There is hereby created the "Beaufort-Morehead City Airport Authority" (for brevity hereinafter referred to as the "Airport Authority"), "Carteret County‑Beaufort Airport Authority" (hereinafter "Airport Authority"), which shall be a body corporate and politic, having the powers and jurisdiction hereinafter enumerated and such other and additional powers as shall be conferred upon it by future Acts of the General Assembly."

SECTION 2.(a)  Section 2 of Chapter 426 of the Public‑Local Laws of 1941, as amended by Chapter 396 of the Session Laws of 1981, reads as rewritten:

"Sec. 2. The Airport Authority shall consist of five seven members. One of the members shall be a resident voter of the City Town of Beaufort and shall be appointed by the City Town Commissioners of the City Town of Beaufort. One of the members shall be a resident voter of the City of Morehead City and shall be appointed by the City Commissioners of the City of Morehead City, and the other three Six of the members shall be from the county at large resident voters of Carteret County and shall be appointed by the Carteret County Board of Commissioners. The said members of the Airport Authority shall be appointed to serve for a period of two years. Each of the members and their successors so appointed shall take and subscribe before the Clerk of Superior Court, Court an oath of office and shall file the same with the Carteret County Board of Commissioners."

SECTION 2.(b)  This section becomes effective August 31, 2019. The terms of the two new members of the Airport Authority authorized by this section shall begin on September 1, 2019. The term of the City of Morehead City appointee shall expire on the effective date of this section and a replacement shall be named by the Carteret County Board of Commissioners as provided in this section.

SECTION 3.  Section 5 of Chapter 426 of the Public‑Local Laws of 1941, as amended, reads as rewritten:

"Sec. 5. The Airport Authority is hereby authorized and empowered to acquire from the County of Carteret, the Cities of Beaufort and Morehead City, Carteret and the Town of Beaufort, by agreement therewith, and such the county and cities town are hereby authorized and empowered to grant and convey, either by gift or for such consideration as it may be deemed wise, any real or personal property which it now owns or may hereafter be acquired, and which may be necessary for the construction, operation and maintenance of any airport located in the County of Carteret."

SECTION 4.  Except as otherwise provided, this act is effective when it becomes law.
