HOUSE BILL 658
AN ACT modifying the expired drug provision of the drug, supplies, and medical device repository program to allow for the acceptance and dispensing of drugs that have not reached their expiration date FOR THE PURPOSE OF INCREASING ACCESS FOR INDIVIDUALS WHO ARE UNINSURED OR UNDERINSURED.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 90‑85.44(c) reads as rewritten:
"(c) Requirements of Participating Pharmacists or Free Clinics. – A pharmacist may accept and dispense drugs, supplies, and medical devices donated to the Program to eligible patients if all of the following requirements are met:
…
(3) The drug bears an
expiration date that is later than six months after the date that the drug was
donated.has not reached its expiration date.
…."
SECTION 2. This act is effective when it becomes law.
