HOUSE BILL 80

 

 

AN ACT to regulate unattended equipment used for waterfowl HUNTING ON ROANOKE RAPIDS LAKE IN northampton and halifax counties.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  During the waterfowl seasons established by the Wildlife Resources Commission, it shall be unlawful to leave unattended or unoccupied any equipment or vessels that may be used for the purpose of taking migratory waterfowl, including, but not limited to, mobile or temporary blinds, layout boats, and decoys, prior to 4:00 A.M. each day. All such unattended equipment and unoccupied vessels must be removed by two hours after sunset each day unless remaining on a portion of the shoreline or attached to a dock as authorized by the owner of the shoreline or dock.

SECTION 2.  Violation of this Act shall be a Class 2 misdemeanor punishable by a fine of not less than two hundred fifty dollars ($250.00) in addition to any other punishment prescribed for that offense.

SECTION 3.  This act is enforceable by law enforcement officers of the Wildlife Resources Commission, by sheriffs and deputy sheriffs, and by other peace officers with general subject matter jurisdiction.

SECTION 4.  This act applies only to Roanoke Rapids Lake in Halifax and Northampton Counties.

SECTION 5.  This act becomes effective October 1, 2019, and applies to offenses committed on or after that date.
