AN ACT TO realign THE TERMS OF OFFICE for CERTAIN MEMBERS OF THE BOARDs OF trustees of certain community colleges.

 

The General Assembly of North Carolina enacts:

 

Part I. bladen community college

SECTION 1.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, the terms of office for certain members of the Board of Trustees of Bladen Community College shall be revised as follows:

(1)        Of the two terms elected by the Bladen County Board of Commissioners that expire June 30, 2025, the Board shall elect one trustee to a term of two years, beginning July 1, 2025, so that the term expires June 30, 2027.

(2)        Of the two terms elected by the Bladen County Board of Commissioners that expire June 30, 2026, the Board shall elect one trustee to a term of two years, beginning July 1, 2026, so that the term expires June 30, 2028.

(3)        Of the two terms elected by the Bladen County Board of Education that expire June 30, 2026, the General Assembly, upon the recommendation of the Speaker of the House of Representatives, shall appoint one trustee to a term of two years, beginning July 1, 2026, so that the term expires June 30, 2028.

(4)        Of the two terms elected by the Bladen County Board of Education that expire June 30, 2027, the General Assembly, upon the recommendation of the Speaker of the House of Representatives, shall appoint one trustee to a term of two years, beginning July 1, 2027, so that the term expires June 30, 2029.

 

Part II. cape fear community college

SECTION 2.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, for the additional term of office of the Board of Trustees of Cape Fear Community College that is to be elected by the Pender County Board of Commissioners, the Board shall elect one trustee to a term of three years, beginning July 1, 2024, so that the term expires June 30, 2027.

 

Part iii. Central Carolina community college

SECTION 3.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, the terms of office for certain members of the Board of Trustees of Central Carolina Community College shall be revised as follows:

(1)        Of the two terms elected by the Chatham County Board of Commissioners that are expiring June 30, 2025, the Board shall elect one trustee to a term of two years, beginning July 1, 2025, so that the term expires June 30, 2027.

(2)        Of the two terms elected by the Harnett County Board of Commissioners that are expiring June 30, 2025, the Board shall do the following:

a.         Elect one trustee to a term of one year, beginning July 1, 2025, so that the term expires June 30, 2026.

b.         Elect one trustee to a term of three years, beginning July 1, 2025, so that the term expires June 30, 2028.

 

Part iv. James sprunt community college

SECTION 4.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, of the two terms of office of the Board of Trustees of James Sprunt Community College that are elected by the Duplin County Board of Commissioners and expire June 30, 2025, the Board shall elect one trustee to a term of two years, beginning July 1, 2025, so that the term expires June 30, 2027.

 

Part v. Johnston community college

SECTION 5.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, and notwithstanding Section 6.10(p) of S.L. 2023‑134, the terms of office for certain members of the Board of Trustees of Johnston Community College shall be revised as follows:

(1)        The term of Ms. Lyn T. Austin, appointed by the Governor, or any member appointed to fill a vacancy in that seat for the remainder of the unexpired term in accordance with subdivisions (1) through (3) of subsection (p) of Section 6.10 of S.L. 2023‑134, shall be extended for two years so that the term expires June 30, 2026.

(2)        The term of Mr. Robert Bryant, appointed by the Governor, or any member appointed to fill a vacancy in that seat for the remainder of the unexpired term in accordance with subdivisions (1) through (3) of subsection (p) of Section 6.10 of S.L. 2023‑134, shall be extended for one year so that the term expires June 30, 2027.

(3)        The term of Mr. R.S. Lawter, Jr., elected by the Johnston County Board of Commissioners, or any member appointed to fill a vacancy in that seat for the remainder of the unexpired term in accordance with subdivisions (1) through (3) of subsection (p) of Section 6.10 of S.L. 2023‑134, shall expire June 30, 2026.

(4)        The term of Mr. Reid Williams, elected by the Johnston County Board of Education, or any member appointed to fill a vacancy in that seat for the remainder of the unexpired term in accordance with subdivisions (1) through (3) of subsection (p) of Section 6.10 of S.L. 2023‑134, shall expire June 30, 2026.

 

Part vi. Lenoir community college

SECTION 6.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, for the one term of office of the Board of Trustees of Lenoir Community College that is elected by the Greene County Board of Commissioners and expires June 30, 2025, the Board shall appoint one trustee to a term of one year, beginning July 1, 2025, so that the term expires June 30, 2026.

 

Part vii. Pitt community college

SECTION 7.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, the terms of office for certain members of the Board of Trustees of Pitt Community College shall be revised as follows:

(1)        Of the two terms elected by the Pitt County Board of Commissioners that expire June 30, 2025, the Board shall elect one trustee to a term of one year, beginning July 1, 2025, so that the term expires June 30, 2026.

(2)        Of the two terms elected by the Pitt County Board of Education that expire June 30, 2025, the General Assembly, upon the recommendation of the Speaker of the House of Representatives, shall appoint one trustee to a term of one year, beginning July 1, 2025, so that the term expires June 30, 2026.

 

Part viii. Sandhills community college

SECTION 8.  Notwithstanding G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134, for the additional term of office of the Board of Trustees of Sandhills Community College that was elected in 2024 by the Hoke County Board of Commissioners in accordance with G.S. 115D‑12, as amended by Section 6.10(n) of S.L. 2023‑134, the term shall expire June 30, 2027.

 

part ix. MISCELLANEOUS

SECTION 9.(a)  For the boards of trustees of the community colleges addressed in this act, in accordance with G.S. 115D‑12, G.S. 115D‑13, and Section 6.10 of S.L. 2023‑134, the following shall apply for any seat in which a specific term length is not provided or revised:

(1)        For current seats, the term shall expire at the end of its previously appointed or elected term.

(2)        For additional seats to be elected or appointed pursuant to Section 6.10 of S.L. 2023‑134, in order to maintain staggered terms, the initial term shall begin July 1, 2024, and expire June 30, 2028.

SECTION 9.(b)  The successors to the trustees elected or appointed to terms of less than four years or whose terms were otherwise revised pursuant to this act shall be elected or appointed, following the expiration of their terms, to terms of four years on July 1, and every four years thereafter, in accordance with G.S. 115D‑13, as amended by Section 6.10(o) of S.L. 2023‑134.

 

part x. effective date

SECTION 10.  This act is effective when it becomes law.
