Overview: Sec. 14.16A of S.L. 2015-241 phases out the Noncommercial Leaking Underground Storage Tank Fund (which has historically reimbursed individuals for reasonable and necessary costs directly related to the cleanup of a petroleum release from noncommercial underground storage tanks), by limiting reimbursement of claims against the Fund to only those claims associated with releases reported to the Department of Environmental Quality ((DEQ), formerly the Department of Environment and Natural Resources) prior to October 1, 2015, and where the claim for compensation is submitted to DEQ prior to July 1, 2016.
The provisions of this section that repeal the statutes associated with the Noncommercial Leaking Underground Storage Tank Fund become effective December 31, 2016, and the remaining provisions became effective July 1, 2015.
