Overview: Sec. 12H.6 of S.L. 2015-241 directs the Divisions of Medical Assistance and Mental Health, Developmental Disabilities, and Substance Abuse Services within the Department of Health and Human Services (DHHS) to submit a request to the Centers for Medicare and Medicaid Services for approval of the 1915(c) waiver for individuals with traumatic brain injury (TBI) that DHHS designed and which the Joint Legislative Oversight Committee on Health and Human Services (HHS Oversight) recommended in its 2014 report to the General Assembly. DHHS must report to HHS Oversight on the status of the Medicaid TBI waiver request and the plan for implementation on both December 1, 2015, and March 1, 2016. The reports must include: (i) the number of individuals served under the waiver and the total number of individuals expected to be served; (ii) the expenditures to date and a forecast of future expenditures; and (iii) any recommendations regarding expansion of the waiver. This section provides that the waiver and State Plan amendments required to implement this waiver are not subject to the 90-day prior submission requirement under the law governing amendments to Medicaid State Plan and Medicaid waivers.
