H97 - 2015 Appropriations Act, Sec. 29.5: Require County or Municipality to Pay Costs Associated with Requested Project Improvements (SL 2015-241)

Overview: Sec. 29.5 of S.L. 2015-241 requires that pursuant to an agreement with the Department of Transportation, a county or municipality must reimburse the Department for the cost of all improvements requested by that county or municipality. Requests for safety enhancements or efforts to facilitate the flow of traffic are not considered improvements under this section unless the enhancement or effort is in excess of the standard required by law. Previously the law allowed a county or municipality to reimburse the Department but did not require it to do so.
This section became effective July 1, 2015, and applies to agreements entered into on or after that date.
