Overview: Sec. 12H.7 of S.L. 2016-94 repeals the sunset provision on the statute governing income disregard for federal cost-of-living adjustments (G.S. 108A-54.4), which provides that additional income resulting from a Social Security cost-of-living adjustment will be disregarded for purposes of determining Medicaid eligibility, thereby allowing Medicaid beneficiaries to retain Medicaid eligibility despite the additional Social Security income. The statute was enacted in 2012 and was scheduled to sunset on December 31, 2017.
This section became effective July 1, 2016.
