Overview: Sec. 11D.1 of S.L. 2018-5 requires the Division of Aging and Adult Services, Department of Health and Human Services (DHHS), in consultation with the Eastern Band of Cherokee Indians (EBCI), to develop and submit a plan to enable the ECBI to assume responsibility for administering the Home and Community Care Block Grant (HCCBG). The section outlines specified report requirements, including: funding amounts and sources; the number of individuals eligible for HCCBG services and plans to avoid double counting individuals; information on how eligibility will be determined; State and federal laws, rules or other guidance that should be considered; a federal waiver application or State Plan amendment that DHHS would be required to file; explanation and recommendations to address any information technology issues; identification of recurring and nonrecurring implementation costs; a proposed time line for EBCI to assume responsibility; and any other information the DHHS Secretary deems relevant to the EBCI successfully assuming the responsibility. The plan must be submitted to the Joint Legislative Oversight Committee on Health and Human Services and the Fiscal Research Division by February 1, 2019.
