S605 - North Carolina Farm Act of 2021. (SL 2021-78)

Overview: Section 4 of S.L. 2021-78 provides that the Department of Agriculture and Consumer Services may provide either monetary overtime compensation or compensatory leave to employees of the North Carolina Forest Service who are exempt from the Fair Labor Standards Act and involved in fighting forest fires for overtime earned while conducting fire suppression duties. Under prior law, overtime earned by professional employees of the Forest Service while conducting fire suppression duties was required by statute to be provided in the form of monetary compensation.

This section became effective July 2, 2021, and applies to overtime earned on or after that date.
