Overview: Section 16 of S.L. 2026-11 (Senate Bill 401) increases the penalty for the theft of ungathered crops or the theft or injury of aquaculture resources as follows:

  • Adds a fine of $250 for a first offense and $500 for a second or subsequent offense.
  • From a Class H felony to a Class G felony for a second or subsequent offense.

A first offense for either crime would still be punishable by a Class H felony, in addition to the new $250 fine.

This section becomes effective December 1, 2026, and applies to offenses committed on or after that date.
