S257 - 2026 Appropriations Act. (SL 2026-41)

Overview: Section 12.12 of S.L. 2026-41 (Senate Bill 257) provides that specific fees of the Department of Environmental Quality that may be adjusted every four years in accordance with the Consumer Price Index may only be increased to the extent that the fee does not exceed the cost of the service being provided. This section also adds G.S. 143-215.3(a)(1b) to the list of statutes whose fees and rates are subject to the quadrennial fee adjustment, which includes the maximum fees for processing air quality permit applications for non-Title V facilities as well as certain registration, permit administration, and compliance monitoring fees. The initial adjustment for these facilities may only reflect the change in the Consumer Price Index since July 1, 2026.
