Overview: Section 28 of S.L. 2026-59 (Senate Bill 445) reduces the annual operating fee the Secretary of the Department of Environmental Quality (DEQ) can charge the owner or operator of a commercial petroleum underground storage tank (UST) for each UST from $498 to $420 and reduces the daily late penalty from $6 to $5. This section also eliminates DEQ's authority to adjust the UST fee every four years based on changes to the Consumer Price Index.
This section becomes effective October 1, 2026, and applies to any fees due on or after that date.
