H437 - Drug-Free Zones/Unauthorized Public Camping. (Ratified)

Overview: Section 1 of House Bill 437 would have created a Class E felony for anyone who manufactures, sells, or delivers a controlled substance in a drug‑free homeless service zone if the person knows or reasonably should know it is a drug‑free homeless service zone and a Class H felony for any operator of a facility‑based service that intentionally allows a person to manufacture, sell, or deliver a controlled substance in a drug‑free homeless service zone.
House Bill 437 was ratified on July 1, 2026, but was vetoed by the Governor and is not current law. If the General Assembly overrides the veto, Section 1 of House Bill 437 would become effective on December 1, 2026, and apply to offense committed on or after that date.
