Overview: Section 16.22 of S.L. 2026-41 (Senate Bill 257) increases the fee from $100 to $200 that certain persons charged with an implied-consent offense must pay before that person's revoked license may be restored. This results in the following distributions:

  • $50 per fee (25%) credited to the General Fund.
  • $50 per fee (25%) to be used to fund a statewide chemical alcohol testing program administered by the Injury Control Section of the Department of Health and Human Services.
  • $100 per fee (50%) remitted to the county for the sole purpose of reimbursing the county.

This section becomes effective December 1, 2026, and applies to fees assessed on or after that date.
