S257 - 2026 Appropriations Act. (SL 2026-41)

Overview: Section 18.3 of S.L. 2026-41 (Senate Bill 257) requires that, of the funds appropriated in S.L. 2026-41 to the Department of Justice (DOJ) to hire time-limited attorneys, the attorneys hired must focus solely on capital cases.

Any funds described in this section that remain unspent or unencumbered at the end of the 2026-2027 fiscal year must not revert and must remain available until June 30, 2029. Any funds described in this section that remain unspent or unencumbered on June 30, 2029, must revert to the General Fund and remain unspent until appropriated by an act of the General Assembly.

By June 1, 2027, and annually thereafter, the DOJ must report certain information for the year prior to the Joint Legislative Oversight Committee on Justice and Public Safety and the Fiscal Research Division.

This section became effective July 1, 2026.
