Overview: Section 21 of S.L. 2026‑59 (Senate Bill 445) authorizes local governments to contract with third‑party vendors to conduct criminal history record checks required for applicants offered any position that involves working with children. Any contract entered pursuant to this authority ends on or before December 1, 2026, or when the State Bureau of Investigation (SBI) request for proposal to provide the criminal history check is awarded, whichever occurs later. Third‑party vendors are required to comply with any restrictions or requirements set by law governing fingerprints and other information collected by the SBI for a criminal record check.

This section of the act became effective August 11, 2026.
